This agreement is between you and HydraTerms Limited ("Hydra", "we", "us", or the "Licensor")
and governs your use of the Hydra desktop application, its bundled components, and the browser
remote service at hydraterms.com (together, the "Software"). By downloading, installing, or using
the Software you agree to these terms. A desktop End User License Agreement also ships inside the
app as EULA.txt.
You are granted a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, for your own use, subject to these terms. The Software is licensed, not sold; all intellectual property rights remain with the licensor.
Except as permitted by applicable law, you may not: redistribute, sell, rent, sublicense, or transfer the Software; reverse engineer, decompile, or disassemble it; create derivative works; remove proprietary notices; use it to build a competing product or service; or circumvent its technical or account-based limitations.
Parts of the Software connect to our hosted service for authentication, device enrollment, and signaling. You are responsible for your account and enrolled devices. We may suspend or terminate access to protect the service or for violations of these terms. Terminal content flows peer-to-peer between your browser and your enrolled desktop; the hosted service brokers authentication and signaling only. See the Privacy Notice.
Hydra Remote has a base price of 10 USD per month, before tax. Stripe may present and charge an equivalent local-currency price through Adaptive Pricing. Each eligible Hydra account receives one 30-day free trial on its first Hydra Remote subscription. A payment method is collected at Checkout. Cancelling and subscribing again does not restart that period: an eligible return during the original 30 days receives only the time still remaining, and a return after it ends is charged without a new trial. Unless you cancel before the trial ends, the paid subscription begins when the trial ends and then renews monthly until cancelled. A valid promotion code may reduce the amount shown at Checkout; it does not by itself change the subscription's billing period or cancellation terms. Checkout shows the final currency, price, tax, discount, and trial terms before you subscribe.
Subscriptions purchased through a Checkout page identified as Sold through Link use Stripe Managed Payments. For those transactions, you see Link as merchant of record. Stripe and Link process the payment; handle sales tax, VAT, and GST compliance for transactions and countries covered by Managed Payments; send transaction and subscription communications; manage fraud and disputes; and provide transaction-level support and order management. The payment terms displayed at Checkout and Stripe's and Link's applicable terms and privacy notices also apply to that transaction.
HydraTerms remains the product developer, licensor, and service provider. We are responsible for providing access to the Software, product-level support, and legal obligations not assumed by Managed Payments. Use Link to manage payment methods and the subscription, and use Link support to request transaction support or a refund. You may also contact HydraTerms about product access or product issues; we can respond to product questions and can issue refunds or update subscriptions through Stripe where appropriate. Nothing in these terms limits rights you have under applicable consumer law.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND. TERMINAL SESSIONS EXECUTE REAL COMMANDS ON YOUR MACHINES; YOU ARE SOLELY RESPONSIBLE FOR WHAT YOU AND YOUR ENROLLED DEVICES RUN.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF DATA, PROFITS, OR BUSINESS. TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR TEN US DOLLARS IF YOU PAID NOTHING.
These terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales have exclusive jurisdiction over disputes arising from these terms.
